Inheritance Law & Probate Proceedings
For the assets and liabilities of every deceased, the competent district court commences mandatory legal proceedings with the aim of dealing with all matters regarding property according to the wishes of the deceased and according to law.
Civil Law Notaries are appointed by law as court commissioners to conduct these probate proceedings on behalf of the courts. In doing so they have special duties and obligations and are subject to strict confidentiality regulations. The Civil Law Notaries acting in the capacity as Court Commissioners are impartial and unbiased advisers to all parties concerned and inform about the respective rights and obligations.
The Civil Law Notary assists the parties through the entire process of probate proceedings – from the first appointment (the registration of death) to its termination. As an experienced legal counsel the Civil Law Notary continues to assist the parties after the end of the probate proceedings, e.g. with registration in the Land Register or in the Companies’ Register.
The heirs can entrust a Civil Law Notary of their choice to represent them in the probate proceedings.
