For the assets and liab­il­it­ies of every deceased, the com­pet­ent dis­trict court com­mences man­dat­ory leg­al pro­ceed­ings with the aim of deal­ing with all mat­ters regard­ing prop­erty accord­ing to the wishes of the deceased and accord­ing to law.
Civil Law Not­ar­ies are appoin­ted by law as court com­mis­sion­ers to con­duct these pro­bate pro­ceed­ings on behalf of the courts. In doing so they have spe­cial duties and oblig­a­tions and are sub­ject to strict con­fid­en­ti­al­ity reg­u­la­tions. The Civil Law Not­ar­ies act­ing  in the capa­city as Court Com­mis­sion­ers are impar­tial and unbiased advisers to all parties con­cerned and inform about the respect­ive rights and obligations.

The Civil Law Not­ary assists the parties through the entire pro­cess of pro­bate pro­ceed­ings – from the first appoint­ment (the regis­tra­tion of death) to its ter­min­a­tion. As an exper­i­enced leg­al coun­sel the Civil Law Not­ary con­tin­ues to assist the parties after the end of the pro­bate pro­ceed­ings, e.g. with regis­tra­tion in the Land Register or in the Com­pan­ies’ Register.

The heirs can entrust a Civil Law Not­ary of their choice to rep­res­ent them in the pro­bate proceedings.
