For the assets and liabilities of every deceased, the competent district court commences mandatory legal proceedings with the aim of dealing with all matters regarding property according to the wishes of the deceased and according to law.
Civil Law Notaries are appointed by law as court commissioners to conduct these probate proceedings on behalf of the courts. In doing so they have special duties and obligations and are subject to strict confidentiality regulations. The Civil Law Notaries in their capacity as Court Commissioners are impartial and unbiased advisers to all parties concerned and inform about the respective rights and obligations.
From the first appointment (the so called Todesfallaufnamhe or death record) the Civil Law Notary assists the parties to the end of the probate proceedings.
As an experienced legal counsel the Civil Law Notary continues to assist the parties after the end of the probate proceedings, e.g. with the registration in the land register or the company register.
The heirs can entrust a Civil Law Notary of their choice to represent them in the probate proceedings.
